System / Legal Framework

Legal Framework

The legal foundation underpinning all Zytheron Enforcement operations, ensuring every action is grounded in established intellectual property law.

Legal Basis for Enforcement

All enforcement actions conducted through the Zytheron platform are grounded in established intellectual property law, including but not limited to the Digital Millennium Copyright Act (DMCA), the EU Copyright Directive (2019/790), the Berne Convention for the Protection of Literary and Artistic Works, and applicable national copyright statutes.

Our legal team continuously monitors legislative developments across all major jurisdictions to ensure our enforcement protocols remain current and legally valid.

Enforcement Authority

Zytheron acts as an authorized agent on behalf of rights holders who have granted explicit enforcement authority through our platform. All enforcement actions are executed under proper legal authorization, with documented chain-of-authority from the original rights holder.

We maintain strict verification procedures to confirm the legitimacy of rights claims before initiating any enforcement action, preventing unauthorized or fraudulent takedown requests.

International Treaties & Agreements

Our enforcement framework is built upon the following international agreements:

  • WIPO Copyright Treaty (WCT)
  • WIPO Performances and Phonograms Treaty (WPPT)
  • TRIPS Agreement (WTO)
  • Berne Convention for the Protection of Literary and Artistic Works
  • Universal Copyright Convention (UCC)
  • Beijing Treaty on Audiovisual Performances

Notice & Takedown Procedures

Our notice-and-takedown procedures comply with the safe harbor provisions established under the DMCA (Section 512) and equivalent provisions in other jurisdictions. We follow a standardized process that includes proper identification of copyrighted works, identification of infringing material, and good-faith statements of accuracy.

Counter-Notice Process

In accordance with applicable law, Zytheron provides a clear counter-notice process for parties who believe their content was removed in error. Counter-notices are reviewed within 48 hours, and content is restored within 10-14 business days if no court action is initiated by the original complainant.

Legal Resources

Zytheron provides comprehensive legal resources to rights holders, including template enforcement letters, jurisdiction-specific legal guides, and access to our network of intellectual property attorneys across 50+ countries.
